On Wednesday, June 20, President Donald Trump buckled to political pressure and signed an executive order ending separation of parents and their children at the border. While on the surface President Trump’s executive order appears to protect families from separation and abuse, once the layers are peeled back, it’s not that simple. President Trump’s order directs government lawyers to ask for a modification of a 1997 consent decree, known as the Flores settlement, which prohibits the federal government from keeping children in immigration detention for more than 20 days, even if they are with their parents. We have no way of knowing whether courts will agree to this request and, if not, we should immediately challenge the detention of children in these cage-like facilities.
