Businesses that rely on H-1B workers can breathe a momentary sigh of relief, as USCIS recently made two announcements. First, USCIS announced the H-1B registration window will open on March 9, 2021 at noon and run until March 25, 2021 at noon EASTERN time. USCIS expects to notify selected registrations by March 31, 2021. If you are an employer seeking to sponsor a new H-1B employee, now is the time to contact our office and get the process started.
Second, USCIS announced it will delay implementation of the selection rule that would have given first priority to the highest paying jobs/employers. For now, implementation of the selection rule has been pushed back to December 31, 2021. Therefore, any registrations filed during this H-1B cap season will be selected randomly without regard to wage, employer, or any other limiting criteria.
