I-9 Compliance Audits on the Rise

Employers should make certain that their I-9 files are in order. The administration promises to increase worksite audits and worksite raids. This means the government will be contacting employers to conduct an I-9 audit. To prepare, employers should review their I-9 files. If you are not equipped to conduct your own self-audit, contact us so we can pre-audit the files for you. USCIS can impose penalties for paper work violations (missing signature, incorrect dates), unlawful hiring (failure to use I-9 or disregard of the document requirement), and a “pattern or practice” of unlawful hiring (criminal sanctions for multiple and/or repeated offenses). Remember, for the I-9 audit, USCIS must provide 3-days advance notice. Worksite raids, however, will occur without notice. Before you allow officers to enter the workplace, request the subpoena that would allow the government to conduct a search. Whether it is an I-9 audit or a worksite raid, be sure to contact us to protect the interests of you, your company, and your employees.
