The Department of Justice issued a proposed rule that would increase its efforts to eliminate discrimination in hiring and unauthorized employment. If the rule is finalized, it will allow the Justice Department to expand the prohibition on discrimination beyond the I-9 and E-Verify. By doing so, the government will be able to examine more closely how employers hire and monitor employees. Employers should meet with an attorney to evaluate how their immigration policies will be impacted if the rule is finalized.

If your company uses E-Verify for I-9 compliance, you know that it can sometimes be a headache. On October 28, 2015, USCIS has launched three enhancements “to improve effectiveness, efficiency and customer satisfaction.”

First, it has created a Temporary Protected Status (TPS) Auto Extension upgrade. If you have any workers with Temporary Protected Status, this enhancement will improve the system’s ability to confirm automatic employment authorization extensions.

Second, USCIS has redesigned the case details page. This reduced the data fields so the case summary can be printed on one page.

Lastly, any e-mails regarding further action notices or tentative nonconfirmations will include the “myE-Verify Case Tracker” link. This will allow your employees to check the status of their own case. Now, instead of your employees asking you about whether you have received confirmation about their E-Verify case, they will be able to check the status of their case themselves.

It’s always great when USCIS implements positive changes to the immigration system. Please contact your attorney at Rose Immigration Law Firm, PLC if you have any questions regarding I-9 compliance or assistance using the E-Verify program.

Permanent residents do not lose their status unless they are deemed to have abandoned it or they are ordered removed (deported) from the United States. As a result, they are legally authorized to work even if their permanent resident cards are expired. If you have already hired a permanent resident employee, you do not need to reverify him or her. If you are hiring or re-hiring a permanent resident employee but the permanent resident card is expired, you can accept alternative evidence from Lists B and C on the I-9, such as a valid driver’s license and unrestricted social security card to comply with I-9 requirements. Never insist your employees provide you with a permanent resident card or any other type of document listed on the I-9, so long as they can otherwise provide evidence they are authorized to work. If you insist on using a particular document for employment verification, you are committing illegal discrimination based on citizenship, immigration status or national origin. If you have any questions about this, please call us.
