The DV Lottery began running again this week, beginning October 4, 2016, and ending on November 7, 2016. This lottery offers foreign nationals from certain countries a chance at receiving an immigrant visa (permanent residence). Applicants must have been born in a qualifying country that is under-represented in the U.S. population. Applicants also must have completed at least high school or two years of experience in a skilled occupation. CAVEAT: Only one application per person. Individuals who submit more than one application will be automatically rejected. Unlike most immigration benefits, the DV Lottery is free. The H-1B filing window closed April 7, 2015, and we now await completion of the lottery selection process. USCIS received a record 233,000 petitions this year, for a total of 85,000 available visas. There are 65,000 regular cap visas, plus 20,000 for beneficiaries with U.S. master’s degrees of higher. To date, 49% of the cases filed by Rose Immigration Law Firm have been selected in the random lottery, outpacing the 36% acceptance rate of H-1B petitions nationwide.

We will carefully monitor the lottery results and inform employers of remedial options if your case is not selected. In the meantime, we urge all employers to contact your Senators and Representatives and urge them to support immigration reform, executive action, and any other measures that will alleviate the H-1B shortage.

With the welcoming of April, Rose Immigration Law Firm attorneys have filed H-1B petitions for our clients. Pursuant to regulation, USCIS will accept petitions for five business days during the first week of April. It is very clear from economic trends that the 65,000 cap will be reached during the early days of the petition filing; we believe the 20,000 masters cap will be reached during this time as well. This means USCIS will conduct a lottery to select potentially approvable H-1B petitions. Like most employers and their OPT employees, we will wait with bated breath for the results.

Rose Immigration Law Firm attorneys are already in discussions to develop alternative plans for those beneficiaries not selected through the H-1B lottery process. Be sure to check with the attorney assigned to your case for more information.
