On May 19, 2016, USCIS confirmed that it reached the cap for H-2B petitions. Only petitions filed prior to May 12, 2016 will be considered for H-2B petitions with an employment start date before October 1, 2016. A recent study by the bipartisan think-tank, the National Foundation for American Policy, highlights the importance of immigrants to the American economy. The study found that 44 of 87 startups in the U.S. that are valued at $1 billion dollars or more were started by immigrants.

Additionally, immigrants held key roles in the management or product development teams of more than 70% of these highly-valued startups. These companies have created approximately 760 jobs each in the U.S. Chief Executive Officer, Chief Technology Officer, and Vice President of Engineering are the most common key positions held by immigrants in these high-value startups. Interestingly, nearly 25% of the billion dollar startups in the U.S. had a founder who originally entered the U.S. as an international student. Of the billion dollar startups with an immigrant founder, nearly half of those founders originally entered the U.S. as an international student.

These statistics underscore the importance of encouraging the best and the brightest to come to the U.S. to study, live, and work. Making it more difficult to do so only encourages potential entrepreneurs to take their ideas, drive, and hard work elsewhere. If your company uses E-Verify for I-9 compliance, you know that it can sometimes be a headache. On October 28, 2015, USCIS has launched three enhancements “to improve effectiveness, efficiency and customer satisfaction.”

First, it has created a Temporary Protected Status (TPS) Auto Extension upgrade. If you have any workers with Temporary Protected Status, this enhancement will improve the system’s ability to confirm automatic employment authorization extensions.

Second, USCIS has redesigned the case details page. This reduced the data fields so the case summary can be printed on one page.

Lastly, any e-mails regarding further action notices or tentative nonconfirmations will include the “myE-Verify Case Tracker” link. This will allow your employees to check the status of their own case. Now, instead of your employees asking you about whether you have received confirmation about their E-Verify case, they will be able to check the status of their case themselves.

The Department of Homeland Security (“DHS”) is considering instituting a pilot program to speed adjudication of certain employment-based applications and petitions filed at the U.S. – Canada border. Expected to be launched by late 2015, the program is designed to make adjudications at the U.S. – Canada border quicker and less expensive for “known employers.” Although the term “known employer” has yet to be defined, it appears that this expedited category will include trusted employers that have successfully filed at the US-Canada border for business immigration status for their employees.
