Update on Rule to Withdraw H-4 EADs

October 1, 2018

The Department of Homeland Security (DHS) is still planning to issue a draft rule to withdraw the H-4 EAD regulation, according to progress reports required in the ongoing court case, Save Jobs USA v. DHS. The regulation is undergoing final DHS clearance review now and the next progress report is due on November 19, 2018. In the meantime, USCIS is still accepting and adjudicating applications for employment authorization for H-4 spouses. We encourage those who are eligible to apply as soon as possible.
