E-Verify Required for Federal Contractors

September 21, 2011

Effective September 8, 2009, certain federal contractors are required to register for and use E-Verify.There are many exceptions to the rule. The four most common exceptions are contracts that:

  1. cover fewer than 120 days;
  2. are valued at less than $100,000 (simplified acquisition threshold);
  3. involve only work performed abroad;
  4. and include only commercially available off-the-shelf (COTS) items and related services.

Also, if the contract does not specifically require the employer to register for E-Verify, the employer is not subject to mandatory registration.

The USCIS website for E-Verify is www.dhs.gov/e-verify. E-Verify is available for all employers, not just those with federal contracts. However, E-Verify is fairly complex, so we do not recommend it for all companies. If you are considering registering your company, contact our office to consult with one of our attorneys to help you make the best decision for your business.
